Trademark Examination Report (TER)

The Trade Marks Registry Examiner reviews the application and issues a TER accepting it or raising objections. For e-filed applications, this typically occurs within 1 month.

Upon acceptance, the trademark is published in the Trade Marks Journal for 4 months. Third parties can file oppositions during this period.

Trademark Registration Certificate

How long does trademark registration take in India?

Trademark registration in India typically takes 18–24 months from the date of filing, provided no objections or oppositions are raised. The initial Trademark Examination Report (TER) is typically issued within 1 month for e-filed applications. If an objection is raised, it must be responded to within 30 days. What is the difference between TM (™) and the registered trademark symbol (®)?

™ (TM) can be used by any business after filing a trademark application — it signals a claimed trademark even before registration is granted. ® (Registered) can only be used after the trademark has been formally registered by the Trade Marks Registry. Using ® before registration is a legal offence.

Can I register a logo and brand name separately?

Yes. A logo (device mark) and a brand name (word mark) are separate trademarks and can be registered independently in the same class. BigMind Consulting recommends registering both the brand name and logo separately to maximise brand protection.

How many trademark classes are there and which one applies to my business?
